[A] SCOPE AND PURPOSE OF THE GENERAL SHOP CONDITIONS
These General Terms and Conditions, together with the order form and the other elements referred to herein, are intended to regulate the terms and conditions governing the provision of the Greek JURA Online Shop Service ("Service" or "Shop") by “C. SΑRAFIDIS BROS S.A.”, with the distinctive “BERSON” (hereinafter called BERSON), with registered office at St. Anastasias and Laertou Str. (PHILIPPOS BUSINESS CENTER), Municipality of Pilea, Thessaloniki, Greece (Tax Identification Number: 094069562 / Tax Office of Thessaloniki).
The service consists of providing access to the online shop which, in addition to providing information on a range of products and/or services, allows the user to electronically order the products advertised there in, under the terms and conditions described herein.
Product orders must be placed by users aged 18 (eighteen) or over (individuals under this age must be authorized by their representatives). The elements and information transmitted by the user will have full legal effect, with the user recognizing electronic purchases and not being able to claim lack of signature for breach of the obligations assumed.
BERSON reserves the right to update and amend the Terms of Use without prior notice. It is advisable to check the Terms of Use regularly for any updates or changes.
[B] PRODUCT INFORMATION AND CONTENT
BERSON will endeavor to ensure that the information presented does not contain typographical errors,which will be promptly corrected whenever they occur. If you purchase a product that has different characteristics to those presented online, you have the right to cancel the purchase contract under the applicable legal terms (right of free cancellation - see point I).
BERSON will endeavor to send all the products ordered, but it is possible that, in certain cases and due to causes that are difficult for BERSON to control, such as human errors or incidents in computer systems, it will not be possible to make any of the products ordered by the user available. If a product is not available when placing an order, the user will be notified by email or telephone and then be offered the chance to cancel the order with a refund if payment has already made.
All information on prices, promotional actions, and services may be changed at anytime by ΒΕRSON. All information on products and specifications may be changed at anytime by JURA and you may contact JURA for such matters.

[C] LIABILITY
1. All products and services commercialized in the Greek JURA Online Shop are in accordance with the Greek law.
2. The Online Shop has adequate levels of security, however BERSON shall not be liable for any damages suffered by the user and/or third parties as a result of delays, interruptions, errors and suspensions of communications that originate from factors beyond its control, namely any deficiencies or failures caused by the communications network or communications services provided by third parties, the computer system, modems, connection software, or any computer viruses, or arising from the downloading ("download") through the service of files infected or containing viruses or other properties that may affect the user's equipment. If,
for any reason, the access to the Greek JURA Online Shop website is not possible, BERSON shall not be liable for any damages.
3. Data and information queries carried out within the scope of this service are presumed to have been carried out by the user, and BERSON declines any responsibility arising from the abusive or fraudulent use of the information obtained.
4. ΒΕRSON K. SARAFIDIS BROS SA shall not be liable for any loss or damage caused by abusive use of the service that is not directly attributable to it by way of willful misconduct or serious fault.
5. BERSON shall not be liable for any loss or damage arising from the non-fulfilment or defective fulfilment of the service when this is not directly or indirectly attributable to it by way of intent or serious fault,and shall not be liable in particular for (i) errors, omissions or other inaccuracies relating to the information made available through the service; (ii) damages caused by the fault of the user or third parties, including infringements of intellectual property, (iii) non-compliance or defective fulfilment resulting from compliancewith judicial decisions or administrative authorities or (iv) non-compliance or defective fulfilment resultingfrom the occurrence of situations of force majeure, that is, situations of an extraordinary or unforeseeable nature, external to BERSON and which cannot be controlled by it, such as fires, power cuts, explosions,wars, riots, civil insurrections, government decisions, strikes, earthquakes, floods or other natural cataclysmsor other situations not controllable by BERSON that prevent or jeopardize the fulfilment of the obligations assumed.
6. BERSON does not guarantee that:
6.1. The service is provided uninterruptedly, totally secure, error-free or works infinitely;
6.2. The quality of any product, service, information or any other material purchased or obtained through the service fulfils any extraordinary expectations of the user in relation to the same;
Further informs that:
6.3. Any material obtained in any way through the use of the service is used at the user's own risk, and the user is solely responsible for any damage caused to their computer system and equipment or for any loss of data resulting from this operation.
6.4. No advice or information, whether oral or written, obtained by the user from or through the service shall create any guarantee that is not expressed in these General Conditions.
7. User accepts that BERSON can not in any way be held liable for any damages, including, but not limited to damages for loss of profits, data, content, or any other losses (even if user has been previously advised of the possibility of such damages), resulting from:
7.1. The use or inability to use the service;
7.2. The difficulty of obtaining any substitute goods/services;
7.3. Unauthorized access to or modification of personal databases;
[D] CONSUMER OBLIGATIONS
1. The user undertakes to:
1.1 Provide correct personal data and addresses;
1.2 Not use false identities;
1.3 Respect the order limits imposed;
2. If any of the data is incorrect, i.e. insufficient, and for this reason there is a delay or impossibility in processing the order or possible non-delivery, the responsibility lies with the user, and BERSON declines any responsibility. In the event that the consumer violates any of these obligations, BERSON reserves the right to eliminate future purchases, block access to the shop, cancel the supply of any other services made available simultaneously by BERSON to the same user and also, not allow future access by the user to any or all services made available by ΒΕRSON K. SARAFIDIS BROS SA.
3. It is expressly forbidden to use the products and services purchased for commercial purposes, namely for the purpose of reselling goods.
[E] PRIVACY AND PROTECTION OF PERSONAL DATA
1. BERSON guarantees the confidentiality of all data provided by users.
2. The personal data identified on the order form as having to be provided is indispensable to service provided by ΒΕRSON K. SARAFIDIS BROS SA. The omission or inaccuracy of the data provided by the user is their sole and entire responsibility and may result in BERSON refusing to provide the service.
3. The user's personal data will be processed and stored by computer and is intended to be used by BERSON within the scope of the contractual and/or commercial relationship with the user and, if authorized by the user, to receive marketing communications from ΒΕRSON K. SARAFIDIS BROS SA, such as news, campaigns and promotions.
4. Under the terms of the applicable legislation, the user is guaranteed, free of charge, the right to access, rectify and update their personal data, directly or upon written request, as well as the right to oppose the use of the same for the purposes set out in the previous paragraph, and for this purpose should contact the entity responsible for processing personal data: ΒΕRSON
5. The Internet is an open network, so the user's personal data, other personal information and all the content hosted on the service may circulate on the network without security conditions, they may be accessed and used by unauthorized third parties, and BERSON cannot be held responsible for such access and/or use.
6. Privacy Policy.
The use of this website is subject to the Privacy Policy mentioned below, and the user must check the respective terms with each new use.
6.1. Our policy.
Users have the right to protection of their personal data. BERSON respects users' right to information about the collection and processing of their personal data. BERSON guarantees that personal data is processed correctly and lawfully in Greece, in accordance with good practice. This site has been designed so that the collection and use of your personal data is minimal and does not exceed the original purpose for which it was collected.
6.2. Processing of personal data.
Your personal data is collected and processed by BERSON only for purposes strictly linked to the use of this website, its services and the purchase of products. However, your personal data may also be used for other processing operations that fall within the limits of these uses:
6.2.1 Whenever you carry out a purchase process for products sold on this site, we collect your personal data (e.g. your name, e-mail address, delivery address, telephone number) on the purchase form, solely for the purposes of selling, sorting and transporting the products ordered;
6.2.2 If you authorize us to do so by ticking the relevant box on the same purchase form, we will also use this data for marketing communications from ΒΕRSON K. SARAFIDIS BROS SA;
6.2.3 Whenever you request service assistance, we collect your personal data (e.g. name, e-mail address and telephone number) in order to provide you with the Online Shop's Customer Support services;
6.2.4 Whenever you save a delivery address, we collect your personal data in order to simplify the preparation of your future orders.
6.3. Disclosure of personal data.
Your personal data may be disclosed to third parties providing specific services, such as external entities contracted by ΒΕRSON K. SARAFIDIS BROS SA. Any disclosure will be made without going beyond the purpose for which your personal data was collected and subsequently processed. In addition, your personal data may be disclosed to third parties in order to comply with applicable laws or to respond to judicial and governmental enquiries
6.4. Processing and security
6.4.1. BERSON guarantees the confidentiality of all data provided by users.

Under the terms of the applicable legislation, the user is guaranteed, free of charge, the right to access, rectify and update their personal data, directly or upon written request, as well as the right to oppose the use of the same for the purposes set out in the previous paragraph, and for this purpose should contact the entity responsible for processing personal data: ΒΕRSON K. 6.4.5. 6.4.6. Modifications to the Privacy Policy.
BERSON reserves the right to change all or parts of this Privacy Policy at any time, even if not required by applicable laws and regulations. All changes and updates will come into effect after their publication on this part of the website. Therefore, you should regularly access this section of the website in order to see the updated version of our Privacy Policy.
6.4.7. Third-party content.
This site may contain links to other sites that are not under the responsibility of ΒΕRSON K. SARAFIDIS BROS SA.
[F] CANCELLATION OF ORDERS
1. At the user's request, they can cancel their order by contacting BERSON by telephone or e-mail with the order number, which will be accepted as long as the order has not yet been processed. Once the order has been processed, BERSON will try to deliver it, but the User has the option of not accepting it.

BERSON reserves the right not to process orders when it finds any inconsistency in the personal data submitted or observes misconduct on the part of the buyer. BERSON reserves the right not to process any order or refund in the event of errors in the values and/or characteristics of the products when these are the result of technical problems or errors beyond the control of ΒΕRSON K. SARAFIDIS BROS SA.
[G] RETURN (RIGHT OF WITHDRAWAL)
1. The user, if he/she is a consumer, may exercise the right of withdrawal without any compensation being required, within 14 (fourteen) days of the day on which the consumer acquires physical possession of the goods.
The communication must be made by letter, by returning the purchased good or by another suitable means that can be proved within the period defined above. The consumer must return the goods to BERSON in their proper condition of use within 14 (fourteen) days from the date of communication of cancellation.

The packaging must be returned complete, as it was delivered and accompanied by all the documentation received, namely the following documents: sales invoice and the document proving receipt of the product. The packaging and documents must be sent free of charge to the following address:

If the user opts for other forms of return, the respective postage costs will be their responsibility.
2. Upon receipt of the return at ΒΕRSON K. SARAFIDIS BROS SA, the user will be refunded the amount paid for the order (value of the sales invoice). If you have used a promotional discount code, this amount will not be refunded, i.e. the refund will only be for the amount actually paid.
3. Since you made your payment by depositing in our bank accounts, when IBAN information is provided, as required by the bank document, the refund will be made to the bank account indicated. The refund will be made within 14 days of receipt of the cancellation notice and receipt of the return of the goods.
4. If any of the components of the item sold are missing, or if any of them are not in excellent condition, there will be no refund of the price or postage, and the product will be sent back to the original dispatch address.
[H] MANUFACTURING DEFECT
1. In the event of a "manufacturing defect", i.e. when equipment malfunctions are detected which, in principle, do not fall within the scope of the respective guarantee, the user must return the equipment, together with a copy of the invoice and the completed "Equipment Exchange/Return Request" form, within a maximum of 30 calendar days from the date of the invoice, to the following address:

If the user opts for other forms of return, the postage costs will be your responsibility.
2. In order for the product to be exchanged, you must ensure that the packaging is original and complete (box, instruction manual, guarantee certificate, terminal and accessories) containing all the constituent components in an excellent state of repair.
3. If any of the aforementioned elements are missing, or if any of the components are not in excellent condition, no exchange will be made and the product will be sent back to the user.
[I] WARRANTY
1. All the equipment available in the Shop is duly certified by the competent international organizations.
2. The equipment and accessories have a warranty period defined by the manufacturer, which under legal terms is 25 (twenty-five) months for household products and 1 (one) year for professional products. This period is considered to run from the date of the equipment's invoice and can only be exercised on presentation of the warranty certificate and/or duly completed proof of purchase (invoice).
3. Equipment that has exceeded the period defined by the manufacturer or has defects caused by abnormal wear and tear, improper installation, inclement weather, electrical discharges, negligence or accidents, mishandling, moisture/liquid infiltration, use of non-original accessories and technical interventions by unauthorized personnel is considered to be out of warranty.
4. If the equipment breaks down, and if it is covered by the warranty, the user may take it and the respective proof of purchase and/or warranty to a brand technical assistance center.
5. Accessories covered by the guarantee that break down must be sent with proof of purchase and/or guarantee to the following address with Geniki Taxydromiki:

If the user opts for other forms of return, the respective postage costs will be their responsibility. The user must always request the Transporter receipt proving that the order was sent.
6. If the equipment breaks down and the breakdown is not covered by the warranty, the user may take the equipment and proof of purchase to a brand technical assistance center.
[J] INTELLECTUAL PROPERTY
1. The Shop is a registered site by JURA and the Service provided by the site itself is the responsibility of ΒΕRSON.
2. The user recognizes that the service contains confidential information and is protected by copyright and related rights, industrial property and other applicable legislation.
3. The user acknowledges that any content appearing in the advertising, highlighting, promotion or mention of any sponsor or advertiser is protected by the laws relating to copyright and related rights, the laws relating to industrial property and other property protection laws, so that any use of such content may only occur under the express authorization of the respective owners.
4. The user undertakes to fully respect the rights referred to in the previous paragraph, namely by refraining from carrying out any acts that may violate the law or these rights, such as the reproduction, commercialization, transmission or making available to the public of this content or any other unauthorized acts that have the same content as their object.
[K] SERVICE SAFETY CONDITIONS
1. The user undertakes to comply with all applicable legal provisions, namely not to practice or encourage the practice of illegal acts or acts that offend good customs, such as the indiscriminate sending of unsolicited communications (spamming) in violation of the provisions of the legislation applicable to the processing of personal data and advertising communications through automatic calling devices, and must also comply with the rules for using the Service, under penalty of BERSON suspending or deactivating the service under the terms set out in point 14.
2. The user expressly recognizes and accepts that the IP Network is a public electronic communications network that can be used by several users and, as such, is subject to computer overloads, and therefore BERSON does not guarantee the provision of the service without interruptions, loss of information or delays.
3. BERSON also does not guarantee the provision of the service in situations of unforeseeable overload of the systems on which it is based or of force majeure (situations of an extraordinary or unforeseeable nature, external to BERSON and which cannot be controlled by it).
4. In the event of interruption of the provision of the Service for reasons of unforeseeable overload of the systems on which it is based, BERSON undertakes to regularize its operation as soon as possible.
[L] SUSPENSION AND DEACTIVATION OF THE SHOP SERVICE
1. Irrespective of any prior or subsequent notice, BERSON may, at any time and in its sole discretion, discontinue making the service and/or part of the service available to one or all users.
2. BERSON also reserves the right to immediately suspend or terminate access to the service in the following cases:
2.1. When the user does not comply with the conditions of use referred to and others referred to in the General Conditions;
2.2 When BERSON ceases access to the Online Shop, with prior notice of 15 days before the date of cessation.
2.3 The suspension or termination of the service by ΒΕRSON K. SARAFIDIS BROS SA, under the terms of the preceding paragraphs, shall not entitle the user or third parties to any indemnity or other compensation, and BERSON shall not be held liable or burdened in any way for any consequence resulting from the suspension, cancellation or termination of the Service.
3. In the situations described above, BERSON will notify the user in advance so that he/she can, if he/she wishes, safe guard the content of his/her order viewing area within 3 (three) working days of the e-mail being sent or the information being made available on the service's main page.
[M] COMMUNICATIONS
1. Without prejudice to other forms of communication provided for in these General Conditions, notifications made to the user relating to the service, including any amendments to these General Conditions, may be made to the user's e-mail address, by SMS or telephone contact.
2. The user agrees to receive any communication and/or notification related to the Online Shop at the address,contact telephone number and/or e-mail address ("e-mail") indicated in the order process.
At any time, the user may request not to receive these communications and/or notifications via the Contact Form or via the "Do not receive the Newsletter" option included in each Newsletter.
[N] TECHNICAL CONFIGURATIONS
1. Without prejudice to the provisions of the following paragraph, BERSON may change the service and/or the technical conditions for its provision, as well as the respective rules of use, and shall publicize such changes to the user at least 15 (fifteen) days in advance.

[P] COMPLAINTS
1. The user may submit any contractual disputes to the arbitration and mediation mechanisms that are or will be legally constituted, as well as complain to BERSON about acts and omissions that violate the legal provisions applicable to the acquisition of goods.
2. The complaint must be submitted within a maximum of 30 (thirty) days from the date the user becomes aware of the facts, and will be registered in BERSON's information systems, which must decide on the complaint and notify the interested party within a maximum of 30 (thirty) days from the date of receipt.
[Q] APPLICABLE LAW - JURISDICTION
1. The Contract is governed by Greek law.The exclusive venue and jurisdiction for all disputes or claims arising from or in connection with the use of the website and the Shop shall be with the courts of Thessaloniki.
